Why Get an Attorney?

The bottom line is an attorney knows the law. VA law was written IN FAVOR OF THE VETERAN by Congress, but is commonly misapplied and misinterpreted by the VA, which results in an application of the law that is NOT IN FAVOR OF THE VETERAN. Every day, our team of attorneys strives to make sure the law is applied correctly. Every day, our staff strives to make sure all evidence is submitted and appeals are filed in a timely manner.We work for veterans and their families. We know the system and how it works. If the VA Regional Office fails to comply with remand instructions from the BVA, and if the BVA misapplies the law when it denies your appeal, we are there to file the timely appeals, make the appropriate arguments and follow through to ensure the VA follows the law.

VA Regional Office
We have been instrumental in helping hundreds of veterans obtain their much-deserved disability benefits at the VA Regional Office by evaluating each client’s VA claims folder, filing new claims, requesting all medical records and evidence that has been identified to us, submitting all medical records and evidence we are able to obtain, and presenting all pertinent arguments supported by VA law. We also file all pending appeals for our clients in a timely manner and help our clients understand and fill out the sometimes confusing and often frustrating paperwork required by the VA.

Board of Veterans’ Appeals (BVA)
We have made hundreds of arguments and evidentiary submissions at the BVA. The BVA is the very important second step in the VA appeal process and an attorney’s understanding of the law is quite significant for a veteran’s claim at this level.

Court of Appeals for Veterans’ Claims (CAVC)
The CAVC is the court of judicial review for decisions by the BVA. This is where a veteran most needs an attorney as the arguments made at this level must be purely legal. New evidence cannot be submitted at this level, and arguments cannot be fact-based, which means the veteran should have an experienced attorney who knows VA law in order to stand up to the VA’s attorney. We have been representing veterans successfully at this level for years and enjoy the respect of the VA’s attorneys and CAVC staff. We have obtained favorable results for a majority of our clients at this level because we understand the system and the law.
